Getting a Loan while in Chapter 13 Bankruptcy

One of the common problems that comes up in a bankruptcy is that a person may need to get a loan.

chapter 13

Particularly in a Chapter 13 Bankruptcy that can go on up to 5 years, a lot can happen. Cars break down, houses need repairs, etc.

In Fort Worth we deal with these issues by filing a Motion to Incur Debt. As an attorney, I need to provide the Court with information about your purchase. I need to know what it is you are buying, why you need it, the proposed price, monthly payment and interest rate. We also will need to amend your schedules to demonstrate your ability to pay for the item you are purchasing.

You can take a look at 11 USC 1305 for more information.
